OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED.
 
1.  How to Enter the Contest:

a. The Shoes-Day Contest (the “Contest”) will begin on Tuesday, September 8, 2009 at approximately 9:00am Central Time (CT) and end on Tuesday, September 29, 2009 at approximately 5:00pm CT.

b. To participate in the Contest entrants must be a registered Mix VIP for Mix 96-5. Listeners may join the Mix VIP club at any time during the contest by going to the KHMX website at http://www.mix965houston.com/. All Mix VIP’s must include their first and last name, complete address, city, state, and zip code, telephone number, date of birth and their valid email address. Only one (1) internet entry per person and one (1) internet entry per email address is permitted.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the http://www.mix965houston.com/ web server records the entry information.  Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of an entry form for purposes of these Official Rules.  Use of any device to automate entry is prohibited. The Station’s computer is the official timekeeping device for this Contest.  All entries must be received by Tuesday, September 28, 2009 at 11:59pm CT.

c. On the following dates at approximately 8:00am, CT during the Contest Period, KHMX will randomly draw nine (9) names from all Mix VIP’s received by 11:59pm CT the day before each of the following dates: September 8, 2009, September 15, 2009, September 22, 2009, and September 29, 2009. The nine (9) contestants selected each week will be announced. Only one name will be announced each hour on Tuesday at the following times:  9:10am CT, 10:10am CT, 11:10am CT, 12:10pm CT, 1:10pm CT, 2:10pm CT, 3:10pm CT, 4:10pm CT, and 5:10pm CT. When the contestant hears his/her name, that contestant will have thirty (30) minutes to call 713-212-5965.  If the contestant successfully calls back within thirty (30) minutes of their name being announced on-air, that contestant will win the prize, which will be awarded upon confirmation of Contest eligibility.  If the contestant whose name is announced on-air does not call back within thirty (30) minutes of his/her name being announced on-air, that contestant will forfeit their chance to win.   Once a contestant’s name is selected and called on the air at the times listed above, that contestant’s name is automatically removed from the database of eligible entries.  KHMX is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.  KHMX is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.

d. Only one (1) internet entry per person and one (1) internet entry per email address is permitted.

2.  Eligibility Restrictions:

a. The Contest is open to all KHMX listeners who are 18 years of age or older and reside in the greater Houston metropolitan area.  Employees of KHMX (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Houston metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.

b. Listeners are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion.

c. Winners will be required to sign a liability and publicity release and show a valid government- issued photo identification card and social security card to claim prize.  

d. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3.  Prizes:

a. A maximum of thirty-six (36) prizes will be awarded.  Each prize is $500.00 in the form of a check made out to the winner to pay for a pair of designer shoes. Prizes will be awarded upon confirmation of Contest eligibility. 

b. Prizes will be awarded in the form of a check in the amount of $500.00. The prize will be mailed to the winner within ten (10) weeks of winning.  The Station is not responsible for the safe arrival of a prize or prize certificate.

c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, solely at its discretion, substitute prizes of comparable value or cash due to prize unavailability or where required by law.  The prizes are expressly limited to the items above and do not include taxes, gratuities or any other expense.  Other restrictions may apply.

4. Selection of Winners:

a. Decisions of Station management with respect to the Contest are final.

b. Up to thirty-six (36) winners will be selected in the manner described in Section 1 of these Official Contest Rules.

c. Odds of winning depend, in part, on the number of eligible entries received.

d. Winners must listen to the Station to win, but do not need to be present to win.

e. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within fifteen (15) days of winning or prize will be forfeited and an alternate winner will not be chosen.  
 
5.  Conditions:
a. Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. 

c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process; the operation of the Station’s Web Site or is otherwise in violation of the rules.  It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.

f. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.

h. Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of KHMX, 24 Greenway Plaza, Suite 1900, Houston, TX 77046 or by sending a self-addressed stamped envelope to KHMX. 

6. INTERNET SWEEPSTAKES PRIVACY POLICY
